Your use of GAAPTUS LLC dba Gaaptus4u's ("Gaaptus4u", "we", "us", "our") software, website, mobile applications, content, services, and other offerings (collectively referred to as the "Services") is governed by these terms and conditions. The provision of our Services is contingent upon your unaltered acceptance of these terms and conditions, as well as all other operating rules, policies (including, but not limited to, our Privacy Policy and Administrative Policy), procedures that may be periodically published on Gaaptus4u.com ("the Site"), and all applicable laws (collectively referred to as the "Agreement").

Please review this Agreement carefully prior to accessing or using our Services. By utilizing our Services, you ("User", "you", "your") signify your agreement to abide by the terms and conditions of this Agreement. If you don't agree with any part of these terms and conditions, you are prohibited from accessing or using our Services.

We reserve the right, at our discretion, to alter, modify, add, or remove portions of these terms at any time. We recommend that you periodically review these terms for any changes. Your continued use of the Site following the posting of changes indicates your acceptance of those changes.

1. Account Registration. If you establish an account on the Site, you'll be required to provide specific registration details or other information. Your use of this Site hinges on the accuracy, currency, and completeness of all information you provide. Should we suspect that your provided information is inaccurate, outdated, or incomplete, we reserve the right to deny, terminate, or suspend your access to the Site and Services at any given time.

2. Account Security. You bear the responsibility for safeguarding the confidentiality of your Site account user ID and password. You are obliged to promptly alert us of any unauthorized access to your account or any other security breaches. We disclaim liability for any damages or consequences incurred due to your actions or omissions, including failure to maintain account security.

3. License Grant. Upon receipt of the applicable licensing fee for an individual course, Gaaptus4u, as the Licensor, grants you, the Licensee, a non-exclusive, non-transferable, limited license to access, view, and use the selected Course(s) online for a duration of one (1) year. For time-based subscriptions, course availability corresponds to the subscription's duration, commencing on the payment receipt date.

4. Usage Limitations. Unless stated otherwise, all materials like articles, images, designs, icons, and videos that are part of our Services (collectively, the "Content") are protected by copyright. This Content is owned by Gaaptus4u, or by the party identified as the Content provider. When you access any Content from our Site, you need to comply with all copyright notices and restrictions that come with it.

You are not allowed to copy, reproduce, or distribute the Content from our Site in any way. However, where we specifically allow it, you can download one copy of the Content for your personal, non-commercial use on a single computer. But you must keep all copyright and ownership notices intact. To use the Content for anything else, you need to get permission from Gaaptus4u or the copyright holder mentioned in the Content's copyright notice.

If you want to create a link to our Site, you can do that. But if we ask you to remove the link, you need to do so. Any other use of our Content requires our written permission in advance. Also, you are not allowed to use robots or any other automatic or manual processes to monitor or copy our Site or the Content.

Changing the Content or using it for another purpose is a violation of Gaaptus4u's rights. The use of any of our Content on any other website or computer network is not allowed. All trademarks, service marks, and trade names belong to Gaaptus4u.

5. What You Share With Us. When you share things like content, comments, suggestions, ideas, or any other information with Gaaptus4u through this Site or through email ("Submissions"), you grant us permission to use them for free, in perpetuity, anywhere, and in any way we want. This includes changing them or using them to create new things. We are not obliged to keep Submissions secret, and we can use them in our work, like in developing products or advertising, without having to pay you or anyone else. We are not responsible if anything we do in the future seems similar to your Submissions. We will handle any personal information you share according to our Privacy Policy.

You agree that your Submissions will not be harmful or offensive, invade anyone's privacy, be illegal, or break any laws. You agree not to share any ads, promotions, or requests for money or services without our permission. You also agree that you will not ask other users of the Site to join or become members of any commercial group, online or offline, without our permission.

Generally, we do not monitor or change the contents of Submissions unless we need to maintain the Site or if the law requires us. We can take action to: (1) follow the law or legal processes; (2) protect Gaaptus4u, our users, advertisers, customers, sponsors, or affiliates; or (3) protect the safety of our guests or the public. You are solely responsible for what you communicate. We can monitor, change, or remove any Submissions, but we're not required to do so.

6. Third Party Communications. Gaaptus4u is not responsible for any communication you receive from third parties ("Third Party Communications") related to this Site. This could be direct or indirect communication. If you act or decide not to act because of these communications, we are not liable for that. It is your responsibility to check and confirm whether you can trust the source and content of any Third Party Communications. We do not make any representations about the identity or trustworthiness of the source or content of these communications.

Third-party content might appear on our Site or be available through links from our Site. This could include comments or posts. We are not responsible for any issues like copyright infringement, errors, inaccuracies, defamation, slander, lies, or inappropriate content in this third-party content. The information and opinions in the third-party content do not represent Gaaptus4u's views or beliefs. Also, the views and opinions provided by our employees and agents do not necessarily represent the beliefs and opinions of Gaaptus4u.

7. Intellectual Property. This Agreement does not transfer any intellectual property rights from Gaaptus4u to you. All rights, titles, and interests in such intellectual property will stay with us. Our name, logo, and all other trademarks or registered trademarks associated with the Services are ours. Any other trademarks or logos used on the Site may belong to third parties. Using our Services does not give you permission to use or reproduce any of Gaaptus4u's or any third-party's trademarks.

8. Updates to this Agreement. Gaaptus4u has the right to change or update any part of this Agreement at any time, at our sole discretion. It is your responsibility to regularly check this Agreement for any changes. If you continue to use or access the Services after we post changes to the Agreement, it means you accept those changes. In the future, we may introduce new services or features on the Site. These will also fall under the terms and conditions of this Agreement.

9. Who Can Use Our Service. By using our Services, you're confirming that: (a) you are at least 18 years old; (b) you have not been suspended or removed from the Site before; (c) you are not a direct competitor of Gaaptus4u or connected to a direct competitor in any way; (d) you only have one Gaaptus4u account at a time; and (e) you have the full power and legal right to agree to this Agreement, and doing so does not break any other agreements you are part of.

10. Terminating Your Access. We can terminate your access to all or part of the Site and Services at any time, for any reason or no reason, with or without telling you, effective immediately. If you want to terminate this Agreement or your Site account (if you have one), you can simply stop using the Site. Parts of this Agreement that are meant to continue after it ends (including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) will continue.

11. Not Professional Advice. The content on the Site is provided by Gaaptus4u as a service to our users and the online community. It is not meant to be legal, accounting, tax, financial, or career advice. While we have made an effort to provide quality information, we do not guarantee that it is accurate, complete, up-to-date, or suitable for your needs. If you use the information from the Site or its links, you're doing so at your own risk.

Even though we offer webinars, training courses, and more, you should not solely rely on this information for making business, professional, career, or other decisions. It does not take into account your specific circumstances, which Gaaptus4u does not know. The information on this site is just one source of data you can use in your decision-making process. You should seek direct, professional advice for your issues and not make decisions based solely on the content you read or view on this Site. You agree Gaaptus4u and its content providers are not responsible if you make decisions based on the information you find on this Site.

12. Disclaimer of Warranties. YOUR USE OF THIS SITE AND SERVICES IS AT YOUR OWN RISK. THE CONTENT IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. GAAPTUS4U DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. GAAPTUS4U DOES NOT WARRANT THAT THE SERIVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GAAPTUS4U DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE, OR THE RESULT OF USE, OF THE SERVICES IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE. THE CONTENT MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS, AND GAAPTUS4U MAY MAKE CHANGES OR IMPROVEMENTS AT ANY TIME. YOU, AND NOT GAAPTUS4U, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION IN THE EVENT OF ANY LOSS OR DAMAGE ARISING FROM THE USE OF THE SERVICES. GAAPTUS4U MAKES NO WARRANTIES THAT YOUR USE OF THE CONTENT WILL NOT INFRINGE THE RIGHTS OF OTHERS AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ERRORS OR OMISSIONS IN SUCH CONTENT.

13. Limitation of Liability. NEITHER GAAPTUS4U NOR ANY OF ITS AFFILIATES, EMPLOYEES, OWNERS, OR MANAGERS ("GAAPTUS4U AFFILIATES") SHALL BE LIABLE FOR ANY DAMAGES TO YOU (1) IN EXCESS OF $100 IN THE AGGREGATE FOR ANY AND ALL CLAIMS, OR (2) FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES OR LOSS OF USE, PROFIT, REVENUE OR DATA TO YOU OR ANY THIRD PERSON ARISING FROM YOUR USE OF THE SERVICE, ANY PLATFORM APPLICATIONS OR ANY OF THE CONTENT OR OTHER MATERIALS ON, ACCESSED THROUGH OR DOWNLOADED FROM GAAPTUS4U EVEN IF GAAPTUS4U IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATION OF LIABILITY SET FORTH IN THE PRECEDING SENTENCE SHALL APPLY REGARDLESS OF WHETHER YOU BASE YOUR CLAIM ON CONTRACT, TORT, STATUTE OR ANY OTHER LEGAL THEORY, WE KNEW OR SHOULD HAVE KNOWN ABOUT THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS AND EXCLUSIONS OF LIABILITY SHALL ALSO APPLY TO ANY PROFESSIONAL-CLIENT COMMUNICATION, RELATIONSHIP, OR REPRESENTATION WITH ANY PROFESSIONAL OR CLIENT IDENTIFIED THROUGH YOUR USE OF ANY SERVICES, OR RELATING TO PROFESSIONAL ADVICE OR INFORMATION YOU RECEIVE, VIEW, ACCESS, OR OTHERWISE OBTAIN VIA ANY SERVICES, AND ANY USE OF OR RELIANCE UPON SAID INFORMATION OR ADVICE IS SOLELY AND ENTIRELY AT YOUR OWN RISK.

THE LIMITATIONS OF LIABILITY AND DISCLAIMERS SET FORTH IN THIS AGREEMENT ARE MATERIAL BARGAINED FOR ELEMENTS OF THIS AGREEMENT AND GAAPTUS4U WOULD NOT HAVE PROVIDED THE SERVICE WITHOUT SUCH LIMITATIONS OR DISCLAIMERS.

14. Indemnification. If Gaaptus4u, its contractors, licensors, or their directors, officers, employees, or agents are faced with any claims or expenses (including attorneys' fees) due to your use of the Services or your violation of this Agreement, you agree to cover those costs.

15. Entire Agreement. This Agreement is the full agreement between you and Gaaptus4u regarding the Services. It can only be changed by a written amendment signed by an authorized Gaaptus4u executive or by a revised version posted by Gaaptus4u.

16. Governing Law. Unless another law applies, this Agreement and any access to or use of the Services will be governed by the laws of the state of Virginia, U.S.A, not including its conflict of law provisions. Any disputes will be handled in the state and federal courts located in Prince William County, Virginia.

17. Agreement to Arbitration and Payment of Attorneys' Fees. Any disputes will be resolved by final, binding arbitration under the rules of the American Arbitration Association, held in Washington, D.C., in English. A written decision with legal reasoning will be provided by the arbitrator(s) at either party's request. The party that ultimately loses will cover arbitration fees and reasonable attorneys' fees for both parties. Anyone present at the arbitration must agree in writing to keep the proceedings strictly confidential. Either party can get an injunction (preliminary or permanent) and orders to compel arbitration or enforce arbitration awards in any court with jurisdiction.

18. Severability. If any part of this Agreement is found to be invalid or unenforceable, that part will be interpreted to match the parties' original intent as closely as possible. The rest of the Agreement will still be fully effective. If either party waives any term or condition of this Agreement or any breach of it, it does not mean they waive that term or condition or any future breaches.

19. Non-assignment. You are not permitted to transfer your rights under this Agreement without getting written permission from us first. Gaaptus4u can transfer its rights under this Agreement without any conditions. This Agreement will be binding on and benefit the parties, their successors, and allowed assigns.
